But how do we get around all the mess? Items like:

 - ext3->ext4 conversion
 - lvm format changes
 - dev->udev
 - etc. etc.

Those things can't be handled in a live update. You need to be outside
of the system to do them or you risk losing data and badly upsetting the
running system.
