Hopefully, Red Hat's continued refusals to even consider negotiating
such a "deal" should give you an idea of where Red Hat/Fedora stands
with regards to such issues.
As to the confluence of Software Patents and Freedom, I think you will
find that the FSFs stance on them is that code under a free license is
where their primary focus lies, and that they have little or no concern
around whether that code is patent infringing or not. This is a notable
area where Fedora and the FSF differ (Fedora makes every effort to avoid
infringing software patents, as stupid as they all may be).
