[Fedora-legal-list] BSD3 without binary clause

Hi I am reviewing a package (ghc-X11) which is basically BSD 3 clause without the 2nd binary clause.

http://darcs.haskell.org/packages/X11/LICENSE

Would this just be BSD license?
