  one final thought.  given that this customer is clearly a total
dick, you might still try to be accommodating and give him a clear and
documented warning that his behaviour is unacceptable and that, if it
happens again, you will cancel his account.  if this *does* end up in
court, it will at least show that you *tried* to be reasonable (even
though you really don't need people like this as customers).

  in terms of actually going to court, you have to ask what he would
be demanding in terms of damages, and it's not clear he can ask for
very much.  IANAL, but i can't see *any* grounds for him demanding
some massive settlement or punitive damages since all you're saying is
that you don't want him as a customer anymore.  and, unless you did
agree to a long-term contract with him, you should be able to boot him
off.  (he certainly can't claim abridgement of free speech or
censorship given that there are an infinite number of other ISPs he
can use.)

  again, as others have pointed out, the spam legislation you were
referring to is used to identify when you can *prosecute* someone over
spam.  it has nothing to do with your situation.  you're not trying to
collect damages.  you just want to get rid of the dick.
