ok, so instead of doing the
rpm -ivh
http://ftp.freshrpms.net/pub/freshrpms/fedora/linux/5/freshrpms-release/freshrpms-release-1.1-1.fc.noarch.rpmstep,
i downloaded the .rpm and installed it locally...

now after examining the freshsrpms.repo file in /etc/yum.repo.d, it says
# $Id: freshrpms.repo 3341 2005-06-28 18:40:26Z thias $
[freshrpms]
name=Fedora Core $releasever - $basearch - Freshrpms
#baseurl=
http://ayo.freshrpms.net/fedora/linux/$releasever/$basearch/freshrpms/
mirrorlist=
http://ayo.freshrpms.net/fedora/linux/$releasever/mirrors-freshrpms
enabled=1
gpgkey=file:///etc/pki/rpm-gpg/RPM-GPG-KEY-freshrpms
gpgcheck=1

so i reallly cant find out whats wrong
