issues with iwl3945 and NetworkManager

I have a Dell D830 latitude laptop with an Intel Chipset (3945a/b/g wireless
card)
iwl3945 and mac80211 do not seem to function properly for me, I have since
gotten wireless working by using ipw3945 and wifi-radar, so there is a
definite workaround. Here is relevant information, I am able to reinstall
iwl3945 if required to assist in recreating this issue for anyone that
needs:

(^^ this was prior to blacklisting iwl3945 and mac80211)
Looks like everything is functional and should work normally. however I was
unable to obtain a DHCP address, again with no errors reported. I have
heard reports of iwl3945 working normally for others so I am kind of
hesitant to spam you all with this information.
more info about current modules loaded:
lsmod | grep iwl (produces no output)
lsmod | grep ipw

ieee80211 37777 1 ipw3945
what I have observed is networkmanager is able to view networks however when
attempting to connect, I am unable to receive an IP address, and if the
network has wep enabled I am prompted for the network key at which point
network manager goes directly back to "waiting for network key status" then
after a few seconds I am again prompted for the wep key.
like I said I have a workaround currently, but I'm interested in making sure
this works "out of the box" for other users.
