When I do a "strings" on my /bin/login, on RedHat 4.0, I see "/etc/nologin".
However, touching /etc/nologin AND /nologin doesn't have any effect.  It
definitely looks like a problem with the RedHat /bin/login (from the 30
seconds of looking I've given it :-).  CCing support@redhat.
