No, it isn't. unless you have some clear evidence of this -
RH don't do that on their standard distribution.
They do have some closed-source software (RHN Satellite, for example)
but the distro as far as I know is *all* open-source sw.

AIUI the code you enter allows certain packages to appear in the
installer - and identifies to rhn which components you are entitled to
support and updates for.

I think you'll find the Server install iso images are all the same,
whether you have a subscription for RHEL5 Advanced Platform, or just
plain RHEL5.
